Booking Conditions

Booking & Term's Condition

Before you book a trip or any travel-related products or services with ‘Travel Kutir’, please read and understand the booking conditions detailed below. We strongly recommend that you also read the Essential Trip Information to have a clear understanding of the itinerary and the style of trip you intend to undertake.

1. CONTACT BETWEEN ‘YOU’ AND ‘US/WE/OUR’

All bookings are made with ‘Travel Kutir’ (us/we/our) , . By booking a trip or participating in any of the trip-related products or services, you (the traveller) agree to be bound by the terms and conditions mentioned in:

  • Booking Conditions;
  • Essential Trip Information that applies to your trip

(which constitutes the entire agreement between you and us) and we accept your booking on this basis alone. The services to be provided are those mentioned in the booking confirmation invoice.

You must be at least 18 years of age to make a booking with us. You agree to provide complete and accurate information to ‘Travel Kutir.

In these booking conditions, references to “you” and “your” include the first-named traveller in the booking.

2. BOOKING ON BEHALF OF OTHER TRAVELLERS

If you make a booking on behalf of other participants, you are deemed the designated contact person for every traveller included in that booking. This means that you are responsible for making all due payments to complete the booking, notifying us of any changes or cancellations if required, and keeping your party informed.

By booking a trip or any travel-related products or services on behalf of other travellers, you represent and warrant that you have obtained all the required consents. You are responsible for verifying that any information you provide us with on behalf of other travellers in the booking is accurate and complete. We will, under no circumstances, be held liable for any errors or commissions in the information you provide us with to complete a booking.

3. VALIDITY

Dates and itineraries are valid until 31 December 2024. Beyond 31 December 2024, dates and itineraries are indicative only.

4. DEPOSIT REQUIREMENT

For us to confirm your booking, you are required to pay a non-refundable deposit as specified on our website or in our booking related email communication with you. If your booking is made within 28 days from the trip start date, then the total trip amount is payable at the time of booking.

5. ACCEPTANCE OF BOOKING AND FINAL PAYMENTS

We will issue a booking confirmation invoice, subject to our acceptance of your booking request. A contract will exist between you and us from the date we issue the confirmation invoice. If you book within 28 days before the trip start date, the contract will exist when we accept your payment. You must pay the balance trip amount 28 days before the trip start date. If you do not make the balance trip payment by or before the due date, we reserve the right to treat your booking as cancelled, and any cancellation fee mentioned in clause 7 (Cancellation By You) will apply.

6. YOUR DETAILS FOR BOOKING

For us to confirm your travel arrangements, you must provide us with all the requested details along with the final trip payment. We require your details, including but not limited to your name (as mentioned in your passport), passport and visa details, along with any pre-existing medical conditions that may affect your ability to complete your travel arrangements. If you fail to provide us with your details within the specified time, we reserve the right to treat your booking as cancelled, and any cancellation fees mentioned in clause 7 (Cancellation By You) will be applicable. Please refer to our Privacy Policy for how we treat your personal information.

7. BOOKING AMENDMENTS

If you choose to transfer your booking to either a third party or an alternate trip, such transfers are permitted when operationally possible, and in case of transferring your booking to a third party, the transferee meets all the requirements with the trip. Any booking amendments may require you to pay specific fees. No amendments are permitted to your booking 28 days prior to the trip start date.

8. INCLUSIONS

The land price of your trip includes as explained in the Essential Trip Information:

  • Accommodation
  • Transportation
  • Sightseeing and meals
  • Services of a group leader

9. EXCLUSIONS

The land price of your trip does not include:

  • International or internal flights unless specified
  • Airport taxes or excess baggage charges unless specified
  • Meals except those specified in the Essential Trip Information
  • Tips to local staff, group leaders, local guides, etc.
  • Visa or passport fees or travel insurance
  • Optional activities and personal expenses

10. AGE AND HEALTH REQUIREMENTS

Minimum Age: The minimum age required is 15 at the time of travel. Travellers under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an appointee above the age of 18, appointed by the minor’s legal guardian. One adult may accompany up to 2 minors.

Bookings with a minor are subject to review and approval by ‘Travel Kutir’. If the applicable law for the travelling minor requires the consent of a parent, guardian or any other person, the accompanying adult (legal guardian or the appointee) is responsible for securing all consents and documentation and ensuring they and the minor(s) meet all the legal requirements to travel. Travel Kutir will not be responsible for any fee, damage or losses incurred due to any failure to secure mandatory permits, consents or approvals.

The legal guardian or the appointee will be responsible for the day to day care of the traveller under the age of 18, behaviour, wellbeing and supervision of such minor(s) and jointly accepts these terms and conditions on behalf of minors on their booking, including assumptions of risk and limitations of liability. We do not provide any care services for minors and cannot be held responsible for controlling any minor(s). If the legal guardian elects to designate an appointee, they will be required to complete and sign a relevant document, to delegate their authority.

Maximum Age: Unless specified otherwise, there is no upper age limit on our trips. However, we remind you that our trips sometimes can be physically demanding, and travellers must ensure they have suitable fitness levels to allow full participation. Though we can provide you with mandatory health requirements, we are not medical experts. It is your responsibility to obtain professional medical advice on the latest health requirements and recommendations for your destination at least two months before your trip start date.

11. PASSPORT & VISAS

It is your responsibility to obtain and be in possession of all the relevant travel documentation and identification that you require to enter, depart or travel to any country or region on your trip. This includes a valid passport and visa and all other travel documentation such as permits, vaccination or medical certificates. Your passport must be valid for at least 6 months after your last date of travel. You accept full responsibility for obtaining all the travel-related documentation and are solely responsible for all the costs incurred due to missing or incorrect, or defective documentation. Additionally, you are responsible for the total amount of any loss or expenses incurred by us due to your failure to secure or be in possession of all the relevant travel documentation.

12. TRAVEL INSURANCE

It is mandatory for all the travellers on our trip to be in possession of a valid travel insurance policy when booking the trip. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of coverage. Additionally, we strongly recommend that your travel insurance policy covers cancellation, curtailment, personal liability, loss of baggage and personal effects, and all other expenses that may arise as a result of damage, injury, loss or inconvenience while travelling.

It is mandatory that you provide us with your travel insurance details, including the insurance company’s 24-hour emergency contact number, on the first day of your trip. If you do not provide us with your travel insurance details, you will not be permitted to join the trip. If you have travel insurance connected to your credit card or your bank account, please make sure you have the details of the participating insurer, the insurance policy number and the 24-hour emergency contact number with you rather than the bank account number or credit card details.

13. CHANGE OF ITINERARY

You understand and acknowledge that the nature of such a travel style requires a considerable amount of flexibility to allow for alternatives. It is understood that the trip itinerary, including routes, schedule, amenities and mode of transport, are subject to change due to local or unforeseen circumstances beyond our direct and reasonable control.

While we always try our best to operate the trip as described, we reserve the right to change the trip itinerary for the latest updates to your itinerary.

Before Departure: If we make a major change to your itinerary, we will inform you about the change as soon as possible, if there is time before departure. A major change to the itinerary is deemed to affect at least one day in five of the itinerary. In case of a major change made to your itinerary, you may choose between accepting the change, obtaining a refund of the payment made towards the land portion of the trip only or accepting an alternative trip.

After Departure: We reserve the right to change the trip itinerary after departure due to circumstances beyond our reasonable direct control or Force Majeure Event. In emergency circumstances, you will bear the additional costs to implement any necessary changes to the itinerary.

14. AUTHORITY ON TOUR

Our trips are run by a group leader whose decision is final on all matters bearing the potential to affect the safety and well-being of any traveller or staff member participating in the trip. It is imperative that you always comply with the laws, customs, foreign exchange and drug regulations of the country you visit. If you fail to abide by a decision made by your group leader or interfere with the well-being or operation of the group, the group leader may ask you to leave the trip immediately, with no right to refund. Additionally, we may choose not to carry you on any of our future trips booked.

15. ACCEPTANCE OF RISK

You acknowledge that the nature of the trip may be adventurous, and your participation may involve a certain degree of personal risk. You may be visiting places with geographical, cultural, and political attributes that pose physical challenges or dangers beyond those present in our daily lives.

You acknowledge that you may be exposed to the Covid-19 virus. We will take all reasonable precautions to ensure your safety and require you to follow additional safety protocols on your trip.

We use information from our local government authorities and reports from our contacts to assess the feasibility to operate a trip. Additionally, it is your responsibility to keep yourself acquainted with all the travel-related information, including applicable health risks and the nature of your trip itinerary. You acknowledge that your decision to travel is made considering this information, and you accept that you are aware of the associated personal risks of such travel. To the fullest extent permitted by law, we accept no liability in relation to these risks.

In case of a cancellation, we are not responsible for any incidental expenses or consequential losses that you may incur as a result of your booking, including but not limited to visas, travel insurance, non-refundable flights, loss of earnings or loss of enjoyment.

16. OPTIONAL ACTIVITIES

Optional activities are not included in your trip price. Optional activities do not form part of the trip or this contract. Any assistance or recommendations or advice given by your group leader or local representative (before, on or after a trip) does not render us liable for them in any way.

17. CLAIMS AND COMPLAINTS

If you have a complaint related to your trip, please inform your group leader or our local representative as soon as possible so that they can attempt to resolve your complaint. If you believe that your complaint has not been resolved through the specified means, please raise a future complaint within 30 days of completing the trip.

18. SEVERABILITY

If any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason. In that case, such term or condition shall be deemed severed from this contract or amended accordingly only to such extent necessary for the remaining terms and conditions to survive and continue as binding.

19. PRIVACY POLICY

Any of your personal information that we collect from you will be handled in accordance with our Privacy Policy and may be used for any purpose linked with the operation of the trip. You consent us to pass on your personal information to relevant persons such as our agents or service providers to enable us to operate the trip or, if permitted by all pertinent Spam laws, send you marketing material in connection with our special offers and events.

20. IMAGES AND MARKETING

You agree that, while participating in a trip or any of its related activities, photos, images or videos containing or featuring you may be taken by other participants or our representatives. We consent to any of such pictures being taken and grant a perpetual, royalty-free, worldwide, irrevocable license to ‘Tourrnival Juorrneys’ or any of our representatives, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licenses), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.
